Article 1 – General sale conditions
The present general conditions, the legal notice as well as the booking documents sent to the customer form a contractual whole and constitute the entire contractual relationship between the campsite and the customers. The campsite reserves the right to change the general conditions at any time. Each customer acknowledges having read and understood the present general conditions prior to any booking of a stay, for him/herself and every person participating in the stay and declares accepting them unreservedly. In the event where one of the clauses of the present contract would be rendered null and void by a change of legislation, of regulations or by a legal decision, this would in no case affect the validity and respect of the present General Rental Conditions.
Article 2 – Booking conditions
Any booking request is considered definitive from the moment the campsite has accepted it. The latter has complete freedom to refuse it depending on availability or on any circumstance likely to adversely affect the planned stay. In all cases, the campsite will send a booking confirmation to the customer, by email or post, and will only debit his/her bank account from this moment. Any booking is name-specific. The customer must be over 18 years of age, must participate in the reserved stay and legally transmit the first names, surnames and age of all participants. The campsite has the right to refuse any person not registered on the booking. Any erroneous information is likely to result in cancellation of the stay. Minors not accompanied by their legal guardians are not admitted for health and safety reasons. As for minors accompanying their legal guardians, they are placed under the sole responsibility of the latter and must in no case be left unsupervised in the campsite enclosure.
2.1 Price and payment
The price is given in Euros including VAT and applicable for the 2018 season. They are fixed and definitive. Any subsequent modification of the applicable VAT rate which takes place between the time when the prices were determined and billing of the stay, will result in a proportional modification of the price including VAT, which the customer accepts unreservedly.
The price includes:
- Rental of the fully equipped accommodation or pitch, as defined in the brochures and on the websites;
- Water, gas and electricity consumption;
- Access to the campsite and its facilities as defined in the brochures and the websites;
- Parking space for one car per rental.
The price does not include:
- The cancellation guarantee;
- The reservation costs;
- The different taxes (tourist tax, eco-tax, additional departmental tax…);
- Paying activities proposed by the campsite to be paid on-site;
- Supplements such as cleaning costs;
- Optional equipment.
The campsite will not be held liable for damages resulting from work and development undertaken in order to improve its services. Certain activities and installations are likely to be closed or withdrawn for several causes: climatic reasons, the event of force majeure or non-functioning in early and late season.
For safety and insurance reasons, the maximum number of occupants stipulated per type of accommodation and described in the brochure and the website, must imperatively be respected. The campsite will refuse any person including new-borns exceeding the allowed maximum capacity. Only visitors invited by customers of the campsite will be accepted. If a reservation is made more than 30 days before arrival, payment must take place in the following way:
- At the time of booking, 30% of the amount of the stay options included + administration costs + cancellation guarantee (optional)
- 30 days before the start of the stay, payment of the balance of the stay, options included
As for any booking occurring less than 30 days before the arrival, the entire amount, options included + administration costs + cancellation guarantee (optional)
In case of late arrival, the booking will be retained for 24 hours. After this delay, and in the absence of a letter/email from the customer, the booking will be cancelled with no reimbursement or compensation. There will be no rebate in case of late arrival or early departure.
2.2 Booking and booking modifications
The rented accommodation or pitch is chosen by the campsite depending on availability and the planning. The campsite cannot guarantee in advance a precise plot for the customer. Only the date and type of accommodation are guaranteed.
Any request or modification must take place at least 7 days before the start of the stay. A written request should be send to the campsite, if not, it will be automatically rejected. The requested change will be considered depending on availability. If it is not accepted, the customer must stay according to the initially conditions, or cancel it.
Conforming to the general conditions, any unpaid booking will be cancelled without notification and with no return of the deposit.
Cancellation requests are only taken into account when sent by registered letter with proof of receipt. If the cancellation takes place over 30 days before the arrival date, the deposit will be kept by the campsite. If the cancellation takes place less than 30 days before the arrival date, the entire payment will be kept by the campsite. In all cases the booking costs will be kept by the campsite. In the event of cancellation by CIELA VILLAGE, except in the case of force majeure, the stay will be fully reimbursed and cannot result in payment of damages.
Complying with article L. 121-20-4 of the Consumer Code, the client is informed that the right of retraction does not apply to any service or accommodation rental sold by the campsite at a certain date or for a certain period.
2.5 Cancellation guarantee
We strongly recommend to all our customers to have a cancellation guarantee which remains optional. It covers the amounts paid, apart from the guarantee and booking costs.
This subscription guarantees reimbursement:
- Up to 30 days before the arrival date: 100%
- between 29 and 15 days before the arrival date: 50%
- between 14 and 7 days before the arrival date: 25%
- A cancellation made less than 7 days before the arrival date will not be reimbursement.
The cancellation can only be taken into account if it is send by registered letter with proof of receipt, with supporting documents, at the latest 3 days after the event causing the cancellation. The cancellation guarantee ensures reimbursement of the contractual price of an accommodation when the cancellation occurs between the date of booking and the date of arrival at the campsite, due to an unknown or unforeseeable event at the time of booking.
The guarantee only covers the following incidents:
- Death, serious bodily accident, or serious illness. Applicable only to the insured party, spouse, ascendant/descendant relatives, brother and sister.
- Moving house following a professional transfer.
- Redundancy of the insured, his or her spouse.
- Damage affecting the insured party’s main residence due to fire, water, theft or vandalism, storm, natural disasters. This list is exhaustive.
The cancellation guarantee is no longer valid after the arrival date appearing on the booking and may in no case occur during the stay.
Cancellation guarantee rates:
- Campsite pitch: €10
- Rental: €20
Article 3 – During the stay
3.1 Arrival and departure
> As for campsite pitches:
arrivals take place from 12:00 am to 8:00 pm and departures before 11:00 am. From 07/07/18 to 18/08/18 arrivals and departures only take place on Wednesdays and Saturdays; outside of this period any day of the week.
> As for mobile home rentals:
mobile homes are available from 4:00 pm until 8:00 pm and must be vacated before 10:00 am at the latest on the day of your departure. From 07/07/18 to 25/08/18 arrivals and departures only take place on Wednesdays, Saturdays and Sundays; apart from this period any day of the week. The customer must make an appointment for the inventory of his/her accommodation at the latest the night before his/her departure.
> As for the campsite pitches:
in July and August, a minimum of 7 nights depending on availability; in low season, a minimum of 1 night depending on availability.
> As for accommodations:
in July and August, a minimum of 7 nights depending on availability; in low season, a minimum of 2 nights depending on availability.
> For pitches:
A deposit will be required for the following equipment:
- 100 Euros for refrigerator
- 100 Euros for barbecue rental
> For mobile homes:
You will be asked to pay a single deposit of 500 Euros per mobile home on the day of your arrival. Payment can be made only by credit card.
If the cleaning option at the end of the stay is chosen, it does not include the washing-up of dishes and kitchen utensils. Repair costs may be retained, for any broken or damaged object which has not been replaced and if the accommodation is damaged or not clean. This costs will be retained on the guarantee deposit and a corresponding invoice will be provided.
If the departure times are not respected and the inventory is not carried out, the staff will assess the state of the rental property.
Credit card deposits will be cancelled.
3.4 Return of the keys
The reception staff will give the customers their bracelets the day of their arrival after having registered the customers. The reception staff will also hand over the keys for the accommodation. It is important that the customer checks the inventory as soon as he/she arrives and reports any complaints within the hour following his/her arrival. No complaint will be allowed subsequently.
Any return of keys after 10:00 am or the restoring of the accommodation after 12:00 pm will lead to billing of an additional night.
Pets are allowed in rental properties (max. 1 pet), on condition that they are kept on a lead within the campsite grounds including on the rented pitch, walked outside the campsite for their needs, that their waste is collected and that their behaviour does not disturb tranquillity. It is forbidden to leave your dog alone in the pitch or in the accommodation. Dogs are forbidden in the bathing area, the games area and the toilet facilities. The vaccination record and certificates (rabies mandatory) must be up-to-date. Dogs in the 1st and 2nd categories are forbidden.
3.6. Campsite rules
During the stay, the customer agrees to respect the campsite rules, deposited at the prefecture and displayed in reception. A copy of which will be given to you on request. These rules are applicable to any person residing with him/her or under his/her responsibility, including visitors for the day.
Any breach of these rules will not be tolerated and will lead to immediate expulsion with no possibility of reimbursement. Aggressive and loud behaviour, racist or threatening comments made against other customers, campsite staff, its partners or suppliers will not be accepted.
Article 4 – Responsibility
The campsite cannot be held responsible for loss or theft of personal objects, injuries or damages occurring to the customer or to his/her property during the stay. The customer must take out civil liability insurance and contact his/her usual insurance company to extend the guarantees of his/her multi-risk home insurance to the accommodation occupied for the duration of the stay.
Article 5 – Legal Notice
The information given by the customer is considered as confidential. It will only be used by CIELA VILLAGE itself in order to process the customer’s booking efficiently and to personalise and strengthen the communication and range of services reserved to its customers according to his/her centres of interest.
Complying with the Computing and Freedoms law of 6 January 1978, the customer has the right to access, rectify and oppose personal data concerning him/her. Article 6 – Image rights
During the stay, the customer is likely to be photographed or filmed on the site. Photos or films may possibly by used for commercial or publicity purposes, which the customer expressly consents to and authorises, without compensation. Nevertheless, the customer can oppose this practice, in writing, at the campsite reception during his/her arrival.
Article 7 – Applicable law
The present general conditions are subject to French law and any dispute relating to their application falls within the competence of the courts of Toulon, whatever the customer’s country of origin. All the descriptions, rates and season opening and closing dates published in the previous brochure are cancelled and replaced by the edition of the present brochure. Despite every care taken in producing this brochure, the campsite will not be liable for any errors or omissions. In case of dispute, and after you have submitted the problem to the customer service of the campsite, each customer has the possibility to consult a mediator. This within a maximum of one year from the date of a written claim to the campsite.
